In a swift and unexpected decision, the Environmental Protection Agency today rejected a petition from environmental groups to ban the use of lead in bullets and shotgun shells, claiming it doesn’t have jurisdiction to weigh on the controversial Second Amendment issue. The decision came just hours after the Drudge Report posted stories from Washington Whispers and the Weekly Standard about how gun groups were fighting the lead bullet ban. The EPA had planned to solicit public responses to the petition for two months, but this afternoon issued a statement rejecting a 100-page request from the Center for Biological Diversity, the American Bird Conservancy, and three other groups for a ban on lead bullets, shot, and fishing sinkers. The agency is still considering what to do about sinkers.

Several environmentalist groups led by the Center for Biological Diversity (CBD) are petitioning the EPA to ban lead bullets and shot (as well as lead sinkers for fishing) under the Toxic Substances Control Act (TSCA). Although EPA is barred by statute from controlling ammunition, CBD is seeking to work farther back along the manufacturing chain and have EPA ban the use of lead in bullets and shot because non-lead alternatives are available. But here’s the catch: the alternatives to lead bullets are more expensive. A ban on the sale of lead ammunition would force hunters and sport shooters to buy non-lead ammunition that is often double the cost of traditional lead ammunition. A box of deer hunting bullets in a popular caliber could be upwards of $55. LINK

Once again the left has no compunction about using the power of government to force average Americans do submit to their will no matter if it directly conflicts with the law. This is in my opinion what makes the left so dangerous. In this case we have an unelected, unaccountable government agency, run by career bureaucrats giving credence to the most insane protestations of a fringe group as if they were entirely mainstream and had any case whatsoever.
FOR the record the “TOXIC SUBSTANCE AND CONTROL ACT of 1976” SPECIFICALLY EXEMPTED BULLETS. There are no grounds for the EPA to entertain anything this group has to say in this matter. They have no case and to push ahead with this is an alarming violation of every Americans constitutionally protected right to keep and bear arms. If allowed to go forward this scheme would have the exact same effect as a Poll Tax, something we know is illegal. This attempt will have little chance of surviving legal challenges and shows the outright hostility of the left toward gun owners much the same way they show contempt toward Boy Scouts. I am waiting for the hysterical outcry from the left toward protecting the rights of gun owners just like they seek to protect the rights of Muslims to build at Ground Zero.
Just because you can tax ammunition to the point where it’s unaffordable doesn’t mean you should…right?
